Assembly Bill 8280 (“Prior Approval”)
Legislation was introduced last week that would return NY to prior approval of rates from our current practice of file and use. Prior approval is essentially a regulatory approval process whereby rates cannot go into effect until approved by the Insurance Department. This allows the Superintendent of Insurance complete discretion to determine rates for small businesses and individuals. Please urge your lawmakers to oppose this misguided legislation that would lead to serious unintended consequences.
